I think it’s pretty obvious how they decide.
Clearly, like any mental break, everyone is different.
When they arrived to deal with her, what was she doing? Sitting there.
She was docile, and getting the opportunity to convert them is going to be entirely based on wether they can even be handled with any level of peacefulness.
Our Sandy man? Completely incommunicable, actively rampaging, and with a specific hatred of law enforcement.
Anyone thinking logically would determine him to be a poor candidate for Max Tac.
The other Cyberpsychos we deal with are all absolutely insane as well. With extremely violent tendencies which can’t be repressed.
Unlike our lady here, who went on her rampage, then entered a docile state. Sure c she’s primed to go again, but at that moment, she’s displaying a level of awareness, or at least submission, which makes her someone they can recruit.
Another good candidate MAY EVEN HAVE BEEN Edgerunners pissing man. The guy was just pissing, and clearly insane, BUT, he wasn’t actively rampaging, and only got violent when bothered, revealing his absolutely insane nature.
If he had survived, he’d have likely gone back to doing something mundane like pissing too loudly for people to complain about and then get killed as a result.
But if Max Tac were called on him, and came to find him just chilling and pissing, they might attempt to take him non lethally because he displays a level of aggression which can be controlled to some degree.
If cdpr wants to totally break our hearts, one of the MAXtac bosses would be Mane. It does seem like cyberpsychos get mind-cleansed once they're "recruited"
They probably do a background check during briefing and mental stability assesment on site, if the person they were sent after displays behaviors that contradict their actions, they probably try to take those in instead of outright killing them, but that's just my theory
I assume the decision is left to the higher ups since I wouldn't leave the decision of who lives and dies up to a cyberpsycho. I assume they're wired up to inhibitors or something, only engaging once they're commanded within certain parameters. As to who gets converted to maxtac I don't think they're actively looking for recruits since sadly there will always be more people going cyberpsycho until a cure or prevention is found. I think it maybe more the cyberpsycho's who survive Maxtac despite there determined attempts to put them down. They then get the Alex Murphy treatment
Honestly I feel like they might run it like they do in the tabletop game where once you die you got 10 minutes the longer you go the more brain damage you suffer but this is cyberpunk they can replace messed-up organs with cyber wear, but making them more cyberpsychosis. And even if they damage the body really bad like they did with the sergeant I feel like they can replace their cyber wear making them better!
Interesting I didn't know this lol huh got me thinking tho. Is that why you do all those missions for that woman and she ask you not to kill them? Because they might be able to be part of Maxtac? I always thought Maxtac was just using a lot of cyberware but not so much that they don't go psycho themselves. But maybe that woman really wants to try and cure them, tho that could hinder Maxtac if they are all going to her and getting cured.
I believe the theory that the violent cyber psychos are being hacked/controlled as a vetting process for maxtac or other organizations you the player just happens to arrive at the right place wrong time for them…possibly these organizations hack the person to see them rampage and see how much destruction they can commit or how long they live or something, then they just force them to join maxtec…could even be a way of mindcontrol through the cyberware and their violent outbursts is them trying to fight it off

Who says you're (V) isn't collecting new Max Tac operatives for Regina Jones? CDPR is pretty good at hiding awesome story secrets in plain sight.
